  • Dear Students, Faculty, and Staff,

    To ensure the continued safety of our university community, I have an important announcement about Texas State University operations, spring 2022 course delivery, and student support services.

    In response to the current COVID-19 surge, we will temporarily move class sections to online/remote delivery beginning January 18, 2022, through January 30, 2022. Deans, chairs/directors, and faculty will consult on and communicate with students about courses that may need to remain face-to-face during this two-week period due to licensure requirements or specific academic imperative.

    Face-to-face instruction for all Texas State University courses will resume on January 31, 2022.

    I want to be clear on the following points:

    • No classes are being cancelled.
    • The semester will begin as scheduled on January 18, 2022.
    • Texas State campuses and offices will remain open for business, with services offered in-person and/or virtually. Alkek Library, transportation services, residence halls, dining services, and access to recreation centers, the LBJ Student Center, and the Student Health Center will still be available on our campuses. We request practicing social distancing and wearing masks while in these spaces.

    Our top priority continues to be the safety and health of our students, faculty, and staff. During the month of January, Texas State is taking the following actions to help protect our university community from the spread of COVID-19:

    Testing

    As I mentioned in my December 27, 2021, email, the university requests that all Texas State University students, faculty, and staff get tested for COVID-19 before returning to our campuses for the spring semester. COVID-19 PCR or antigen tests may be used -- including at-home antigen tests.  Testing should be performed within 72 hours (3 days) prior to returning to our campuses.     Residence Halls Students

    Residence halls will open for move-in as planned with all residents required to show a negative COVID-19 test result prior to move-in. The move-in period will be extended for students who choose to come to campus following or during the two weeks of online/remote delivery classes. More information will follow in a direct email to students from the Department of Housing and Residential Life.

    Staff and Workplaces

    Delaying the start of in-person classes will significantly decrease the density of people on our campuses and provide a safer working environment for employees. We encourage remote work and flexible scheduling for employees when possible. Supervisors should work through their division leadership team for approval of plans. Division Vice Presidents will provide further guidance specific to approvals within each division. 

    Events and Activities

    University-sponsored in-person events may be suspended or moved to an online/virtual format. Event coordinators are asked to consult with supervisors to evaluate scheduled in-person events to determine if they will be postponed, cancelled, or transitioned to remote delivery.

    Contact Tracing

    We are expecting a high level of COVID-19 transmission across Texas in January. While our Bobcat Trace contact tracers will be responding to reported cases, it will be a challenge for them to respond quickly due to the anticipated volume of cases. It is up to each member of our community to follow CDC isolation/quarantine guidelines and take the necessary precautions if you are infected or have been exposed to someone who has tested positive. Chief Medical Officer Dr. Emilio Carranco will be sending an email to our community soon to outline important precautions and updated CDC guidelines.

    I cannot stress this enough -- it is critical that we all follow the steps we know protect us from COVID-19. While the university cannot mandate actions, I strongly encourage you to be vigilant about wearing a mask, social distancing as much as possible, test regularly, and get vaccinated and boosted. Continue to watch your university email for other important updates and information.

    I know this is not the start of the semester we were all looking forward to. We are taking these actions out of an abundance of caution and are hopeful the surge will peak quickly. It is our intention -- with your continued commitment and support -- to return to face-to-face instruction on January 31.     Texas State University has the following guidance for your arrival to campus:

    For unvaccinated persons, please review the guidance below from the university COVID-19 Roadmap website which addresses quarantine and testing after international travel:

    • The CDC has issued a public health order requiring all international travelers flying to the United States beginning January 26, 2021 to show proof of a negative COVID-19 test obtained within 3 days of the flight departure date. The COVID-19 test may be a PCR or antigen test. Despite a negative COVID-19 test, international travelers will still be required to self-quarantine for at least seven days upon arrival to the United States. Specifically:
      • While in self-quarantine, practice socially distance from others, wear face masks when around others, and avoid all non-essential activities while in quarantine.
      • You may leave quarantine to carry out essential activities (i.e., completing check-in and employment paperwork and getting a COVID-19 test).
      • Get a COVID-19 test 3-5 days after returning to the United States. If the test is negative, then self-quarantine may end after seven full days. If a test cannot be obtained, then self-quarantine for ten days.
      • Continue self-monitoring for symptoms of COVID-19 and avoid being around others who are at increased risk for severe illness for fourteen days.
      • Students should contact their professors for instructions on managing course work while in quarantine.

    Vaccines are available to all in the Texas State community. We advise you to review Texas State COVID-19 Vaccine Information and arrange your appointment as soon after your arrival as possible.

    For vaccinated persons, the CDC now recommends that

    • You self-monitor for symptoms of COVID-19 and get a COVID-19 test 3-5 days after travel 
    • No automatic quarantine is required for those who are vaccinated.
    • Texas State follows CDC guidance which is updated periodically.

  • Summary of Updates Shared during the April 20, 2021, Town Hall

    Key Highlights for International Students:

    INSTRUCTIONAL DELIVERY MODE

    • Summer 2021: 73 percent of classes will be completely online, and 27 percent will include some form of face-to-face instruction. All summer classes that are scheduled to meet in-person will continue to use a maximum of 50 percent of classroom capacity.
    • Fall 2021: 89 percent of classes will include some form of face-to-face instruction and 11 percent will be completely online. All fall classes that are scheduled to meet in-person will be offered at 100 percent of classroom capacity.

    ACADEMIC MODIFICATIONS

    Academic modifications related to COVID-19 that were granted to eligible students will expire at the end of summer II. Policies and procedures for students with disabilities to request accommodations remain in place.

    EMPLOYEES RETURN IN-PERSON JUNE 1, 2021

    As part of our phased approach to safely resuming a vibrant campus atmosphere and full university operations, starting on June 1, staff and university administrators working from home will return to our campuses and to work schedules they had before the pandemic.

    FACE COVERINGS

    Currently, face coverings are required on Texas State campuses, and will continue to be required through the summer terms. At a later date, the President’s Cabinet and I will determine whether this policy will change in the fall. There are numerous health and safety benefits derived from continuing to wear face coverings even if you are vaccinated. Please continue to wear your face covering!

    VACCINE

    Regular vaccination events will continue on the Texas State campuses throughout the summer. On April 22, we are partnering with Hays County to hold a mass vaccination clinic at the University Events Center. This is a great opportunity for faculty, staff, and students – as well as family members, friends, and retired faculty and staff – to be vaccinated. Getting vaccinated helps us get back the in-person experiences that make Texas State special. Anyone can register for the April 22 vaccination event. Please register today!

    • Message from Dr. Carranco, Director, Student Health Center

    Despite a negative COVID-19 test, students will still be required to self-quarantine for seven days upon arrival to the United States. While in quarantine, students should socially distance from others, wear face masks when around others, and avoid all non-essential activities.

    Completing check-in and employment paperwork and getting a COVID-19 test would be considered essential activities. So, students may leave quarantine to do these essential activities only. Students should get a COVID-19 test 3-5 days after returning to the United States. If the test is negative, then self-quarantine may end after seven full days.

    If a test cannot be obtained, then students should self-quarantine for ten days.       • The spring semester will follow the model established for the fall semester with options for online learning, opportunities for safe face-to-face instruction, limited occupancy in classrooms and other university spaces, mandatory face coverings on campuses, and university event policies that require social distancing and other precautions.

  • All international students returning to campus must follow these guidelines:

    • Quarantine: Students are highly encouraged to quarantine for 14 days before arriving on Texas State campuses. Contact the Student Health Center for more information.
      • If you are enrolled in a course requiring in-person attendance during your quarantine period, please contact your professor as soon as possible.
    • Wear a face covering! Know respect, show respect. Wear your mask to slow the spread of COVID-19 on our campuses. Visit the Face Covering & Mask page for more info on quality, effective face masks
    • Follow the Ten Health and Safety Measures: Including face coverings, social distancing, hygiene practices, cleaning and disinfecting, and more. View Ten Health and Safety Measures
      • Complete a daily self-assessment to check for symptoms
    • Take the Bobcat Pledge: Each member of our community must take steps to protect themselves and others. Pledge to respect yourself and others by making healthy choices.
    • Review your current fall 2020 semester schedule and meet with your academic advisor as soon as possible if you have any concerns.

International Student and Scholar Services

    By now I hope you have read the President’s email regarding that the first two weeks of the Spring 2022 semester will be conducted via remote learning. There is no impact to your F-1 status. F-1 students are permitted to enroll online during the first two weeks of the semester without jeopardizing the F-1 immigration status.

    The April 26, 2021 updated DHS Guidance permits F-1 students to continue following the initial March 2020 DHS Covid Guidance for the 2021-2022 academic year. Please refer to the ISSS COVID-19 website for more information. Below is a summary for new and continuing students.

    Summary of March 2020 Guidance for CONTINUING Students

    As stated in the March 2020 guidance, Active F and M students will be permitted to temporarily count online classes toward a full course of study in excess of the regulatory limits stated in 8 C.F.R. § 214.2(f)(6)(i)(G) and 8 C.F.R. § 214.2(m)(9)(v) for the 2021-22 academic year. The March 2020 guidance applies to continuing F and M nonimmigrant students who were in valid F-1 or M-1 nonimmigrant status on March 9, 2020, including those previously enrolled in entirely online classes who are outside of the United States and seeking to re-enter the country for the 2021-22 academic year. Students actively enrolled at a U.S. school on March 9, 2020, who subsequently took courses online while outside of the country can re-enter the United States, even if their school is engaged solely in distance learning.

    ** If you are a continuing student and plan to study outside the US, please email me so I can update your SEVIS record.**

    Summary of March 2020 Guidance for INITIAL [new] Students

    In accordance with the March 2020 guidance, new or Initial F and M students who were not previously enrolled in a program of study on March 9, 2020, will not be able to enter the United States as a nonimmigrant student for the 2021-22 academic year if their course of study is 100 percent online. A new student should be allowed to enter the United States if they are engaged in a hybrid program, with some requirement for in-person learning. Consistent with this restriction, DSOs should not issue a Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” for a student in new or Initial status who is outside of the United States and plans to take classes at an SEVP-certified educational institution that is operating fully online.

    Overall, ISSS recommends all F-1 students enroll in at least 1 course that has some in-person, or physical attendance requirement, for spring 2022. Per the President’s email, all scheduled face-to-face courses are expected to resume face-to-face instruction beginning January 31, 2022. If you have questions or concerns, please let me know.

    Changes to ISSS during January 18 to January 30

    1. ISSS staff will have rotating remote work schedules
    2. All advising will be conducted virtually only
    3. No walk-in appointments or drop-off requests.
    4. Document pick up will be available M-F, 8am – 5pm.
      • Do not visit the office unless you have been contacted to pick-up a document.
    5. Document submission in-person is not permitted at ISSS. Use the designated online submission portal (i.e. immigration check-in, RCL, CPT, etc.)

    As a reminder, ISSS will routinely publish Covid-related updates on the ISSS COVID-19 website. Please review this website for additional information. Please continue to follow all covid guidelines and safety protocols and be well.

    Here are updates regarding SEVP and the upcoming academic year.

    Texas State University

    On April 20, 2021 during the Town Hall the instructional delivery mode for Summer 2021 and Fall 2021 were announced, “the fall 2021 semester will look much like the 2019 fall semester with a full-slate of in-person classes, university activities, and student support services.” As Texas State University transitions to include more face-to-face classes we will not be back to full normal operations and a hybrid instructional stance is continued.

    • Summer: 73 percent of classes will be completely online, and 27 percent will include some form of face-to-face instruction. All summer classes that are scheduled to meet in-person will continue to use a maximum of 50 percent of classroom capacity.
    • Fall: 89 percent of classes will include some form of face-to-face instruction and 11 percent will be completely online. All fall classes that are scheduled to meet in-person will be offered at 100 percent of classroom capacity.

    SEVP

    On April 26, 2021, the Student and Exchange Visitor Program (SEVP) announced they will extend the COVID-19 guidance originally issued in March 2020 for the 2021-22 academic year.

    • As stated in the March 2020 guidance, Active F students will be permitted to temporarily count online classes toward a full course of study in excess of the regulatory limits stated in 8 C.F.R. § 214.2(f)(6)(i)(G) and 8 C.F.R. § 214.2(m)(9)(v) for the 2021-22 academic year.

    Based on the Texas State’s instructional stance and SEVP COVID-19 exceptions, students may register for any available course regardless of course instruction modality. ISSS recommends at least one face-to-face or hybrid course should any unforeseen changes occur with government regulations and exceptions.


    Travel – Reminders and Precautions

    ISSS does not recommend international travel due to uncertainty with travel restrictions/bans, flight unavailability, embassy closures, quarantine delays, and health and safety risks. Students who choose to travel are traveling at their own risk. Please monitor all COVID-19 updates through the CDC and Department of State websites.

    All F-1 students traveling internationally are required to bring the following documents to show the CBP officer upon reentry to the US:

    • Valid Passport (must have validity for at least 6 months on the date of entry)
    • Unexpired F-1 Visa (Exception: Students traveling to Mexico, Canada, or adjacent Islands (except for Cuba) may use the Automatic Visa Revalidation rule to reenter the US with an expired F-1 visa).
    • Form I-20 with a recent travel signature. How to request a travel signature: 
      1. complete the attached ISSS request form,
      2. email completed form to international@txstate.edu,
      3. ISSS will create a new I-20 with travel signature for you to pick-up or have delivered.
    • ISSS after-hours contact – If you have difficulty with reentry and CBP, please call ISSS or UPD to reach a DSO. DSOs can advocate to CBP for your reentry to the US. The following statement is printed on all I-20s:
      • To reach a DSO, call Texas State University International Student and Scholar Services at 512-245-7966 or the University Police Department after hours (5pm CST M-F and weekends) at 512-245-2805.
    • Student choosing or unable to return to campus should notify ISSS by emailing international@txstate.edu so a DSO can update the SEVIS record.

    Travel – Restrictions to the U.S. from Specific Regions

    • Presidential Proclamations are still in effect and restrict travel to the U.S. for individuals who were physically present in a country/region within the 14 days preceding travel to the U.S. These areas include:
      • Brazil
      • China
      • Iran
      • Schengen Area (Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland) 
      • United Kingdom (England, Scotland, Wales, Northern Ireland)
      • Republic of Ireland
      • India – ADDED 04/30/2021
    • Restriction of Non-Essential Cross-Border Traffic from Mexico and Canada extended until May 21, 2021
      • Exception: Admission to the US is permitted only for travelers engaged in “essential travel.” CBP defined “essential travel” to include international students by stating, "Individuals traveling to attend educational institution" and "Individuals traveling to work in the US" for students on OPT or STEM-OPT.
    • Consult with ISSS to confirm your travel if you are from one of the above-mentioned countries/regions (email international@txstate.edu)
    • Check CDC website for updated list of Presidential Proclamations suspending or limiting international travel: https://www.cdc.gov/coronavirus/2019-ncov/travelers/from-other-countries.html

  • SEVP and Spring 2021 Enrollment Guidance

    • SEVP has not published new or updated guidance for Spring 2021. It is expected the Fall 2020 guidance will remain in effect for Spring 2021.
    • Texas State will continue the Fall 2020 hybrid model with various instructional formats in Spring 2021.
    • Students may register for any available course regardless of course instruction modality.
      • ISSS recommends at least one face-to-face or hybrid course in case SEVP regulations revert back to normal prior to COVID-19.

    COVID-19 Health and Safety Measures

    • Texas State University asks all members of the community to honor the Bobcat Pledge.
      • Keep practicing social distancing, avoid social gatherings, wear a mask, wash your hands often, and complete a daily self-assessment to check for COVID-19 symptoms.
    • Review the attached Student Health Center COVID-19 Isolation Resource and Care Guide and designated COVID-19 resource website.
    • COVID-19 Testing is available on campus and surrounding areas.
    • Contact United Healthcare or Academic HealthPlans for information about the student health insurance COVID-19 coverage.
    • Texas State University is recommending everyone returning from abroad to avoid social gatherings with people for 14 days and take a COVID-19 test prior to returning to campuses or as soon as you arrive. Please refer to the Student Health Center with questions about COVID-19 information and quarantine.

    ISSS – Advising and Services

    • All advising appointments will continue to be conducted remotely until further notice. Call 512-245-7966 to schedule an appointment.
    • ISSS continues to process requests, perform services, and route documents. However, the Thornton International House is closed to outside visitors. Please ring the doorbell or call ISSS for assistance at the door.
    • All OPT applications are completed remotely. Students graduating in Fall 2020 should apply for OPT as soon as possible.
  • Dear International Students and Scholars, 

    For the safety of our students, staff and student workers, we are doing our best to practice social distancing. While our office will continue to function by answering emails, phone calls, and provide virtual advising, we are not accepting walk-in advising at this time. 

    We appreciate your patience as we continue to adapt to a rapidly changing situation. All ISSS advisors are actively checking email, therefore if you have any questions or concerns, please email international@txstate.edu. ISSS will have limited access to the office phone at this time.

  • Students will need to complete our International Student and Scholar Services (ISSS) Request Form and email the completed form to international@txstate.edu 

    1. ISSS will print a new I-20, provide a travel signature, and inform the student the request is complete. 
    2. The student can pick up the new I-20 from the Thornton House or request a shipping label for the I-20 to be mailed.
    3. Please request a shipping label through this link: https://study.eshipglobal.com/  Select the "International Office" as the shipping department. 

    Note: You may leave the country without a travel signature.

  • Broadcast Message: ICE Continues March 2020 Guidance for the 2022-23 Academic Year

    General Information

    The Student and Exchange Visitor Program (SEVP) will extend the guidance originally issued in March 2020 for the 2022-23 academic year. This guidance enables schools and students to engage in distance learning in excess of regulatory limits due to the continuing public health concerns created by COVID-19. The March 2020 guidance applies to nonimmigrant students who were actively enrolled at a U.S. school on March 9, 2020, and are otherwise complying with the terms of their nonimmigrant status, whether from inside the United States or abroad. A summary of the March 2020 guidance is available below. Significantly, there are no changes to the original guidance, which will remain in effect during the 2022-23 academic year.

    Summary of March 2020 Guidance for Continuing Students

    As stated in the March 2020 guidance, Active F and M students will be permitted to temporarily count online classes toward a full course of study in excess of the regulatory limits stated in 8 C.F.R. § 214.2(f)(6)(i)(G) and 8 C.F.R. § 214.2(m)(9)(v) for the 2021-22 academic year.     Procedural Change Plans for SEVP-certified Schools

    If an SEVP-certified school has previously submitted a procedural change plan detailing its alternative procedures, it does not need to resubmit the plan for the 2021-22 academic year, unless the school is making substantive changes. Consistent with the provisions of the March 2020 guidance, substantive changes should be submitted to SEVP within 10 business days of the decision to implement the change.     SEVP recently updated its frequently asked questions with information to clarify the application of the March 2020 guidance to the 2022-23 academic year and will continue to update these resources with the latest information and guidance for stakeholders. The program will continue to provide updates to the academic community through our communication channels, including Broadcast Messages, SEVP field representatives, Study in the States blog posts and social media.   • Broadcast Message: ICE Continues March 2020 Guidance for the 2021-22 Academic Year

    General Information

    The Student and Exchange Visitor Program (SEVP) will extend the guidance originally issued in March 2020 for the 2021-22 academic year. This guidance enables schools and students to engage in distance learning in excess of regulatory limits due to the continuing public health concerns created by COVID-19. The March 2020 guidance applies to nonimmigrant students who were actively enrolled at a U.S. school on March 9, 2020, and are otherwise complying with the terms of their nonimmigrant status, whether from inside the United States or abroad. A summary of the March 2020 guidance is available below. Significantly, there are no changes to the original guidance, which will remain in effect during the 2021-22 academic year.

    Summary of March 2020 Guidance for CONTINUING Students

    As stated in the March 2020 guidance, Active F and M students will be permitted to temporarily count online classes toward a full course of study in excess of the regulatory limits stated in 8 C.F.R. § 214.2(f)(6)(i)(G) and 8 C.F.R. § 214.2(m)(9)(v) for the 2021-22 academic year. The March 2020 guidance applies to continuing F and M nonimmigrant students who were in valid F-1 or M-1 nonimmigrant status on March 9, 2020, including those previously enrolled in entirely online classes who are outside of the United States and seeking to re-enter the country for the 2021-22 academic year. Students actively enrolled at a U.S. school on March 9, 2020, who subsequently took courses online while outside of the country can re-enter the United States, even if their school is engaged solely in distance learning.

    Summary of March 2020 Guidance for INITIAL Students

    In accordance with the March 2020 guidance, new or Initial F and M students who were not previously enrolled in a program of study on March 9, 2020, will not be able to enter the United States as a nonimmigrant student for the 2021-22 academic year if their course of study is 100 percent online. A new student should be allowed to enter the United States if they are engaged in a hybrid program, with some requirement for in-person learning. Consistent with this restriction, DSOs should not issue a Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” for a student in new or Initial status who is outside of the United States and plans to take classes at an SEVP-certified educational institution that is operating fully online.

    Procedural Change Plans for SEVP-certified Schools

    If an SEVP-certified school has previously submitted a procedural change plan detailing its alternative procedures, it does not need to resubmit the plan for the 2021-22 academic year, unless the school is making substantive changes. Consistent with the provisions of the March 2020 guidance, substantive changes should be submitted to SEVP within 10 business days of the decision to implement the change.   • Follow these tips to ensure you are able to maintain your F-1 status, continue practical training and/or travel safely.

    • Maintain status: It is important that F-1 students maintain their nonimmigrant student status, even during emergency events. This means you must continue to take all the necessary actions to remain in status, to the extent possible under the circumstances. You must also communicate with your designated school official (DSO) about the emergency plans on your campus, including any changes to your address.
    • Be cautious traveling: Refer to guidance from the CDC, U.S. Department of State and the U.S. Department of Homeland Security (DHS), Customs and Border Protection (CBP) for specific port-of-entry screening processes, as well as any travel restrictions.

      General Information

      Temporary procedural adaptations related to online courses permitted by the Student and Exchange Visitor Program (SEVP) during the height of the Coronavirus Disease (COVID-19) crisis will be modified for the fall 2020 semester. There will still be accommodations to provide flexibility to schools and nonimmigrant students, but as many institutions across the country reopen, there is a concordant need to resume the carefully balanced protections implemented by federal regulations. The U.S. Department of Homeland Security plans to publish the procedures and responsibilities described in the below Broadcast Message in the near future as a Temporary Final Rule in the Federal Register. This message is intended to provide additional time to facilitate the implementation of these procedures.

      Due to COVID-19, SEVP instituted a temporary exemption regarding the online study policy for the spring and summer semesters. This policy permitted F and M students to take more online courses than normally allowed for purposes of maintaining a full course of study to maintain their F-1 and M-1 nonimmigrant status during the COVID-19 emergency.

      Temporary Exemptions for the Fall 2020 Semester

      For the fall 2020 semester, SEVP is modifying these temporary exemptions. In summary, temporary exemptions for the fall 2020 semester provide that:

      1. Students attending schools operating entirely online may not take a full online course load and remain in the United States. The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online for the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States. Active students currently in the United States enrolled in such programs must depart the country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status or potentially face immigration consequences including, but not limited to, the initiation of removal proceedings.
      2. Students attending schools operating under normal in-person classes are bound by existing federal regulations. Eligible F students may take a maximum of one class or three credit hours online (see 8 CFR 214.2(f)(6)(i)(G)).
      3. Students attending schools adopting a hybrid model—that is, a mixture of online and in person classes—will be allowed to take more than one class or three credit hours online. These schools must certify to SEVP, through the Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” that the program is not entirely online, that the student is not taking an entirely online course load for the fall 2020 semester, and that the student is taking the minimum number of online classes required to make normal progress in their degree program. The above exemptions do not apply to F-1 students in English language training programs or M-1 students, who are not permitted to enroll in any online courses (see 8 CFR 214.2(f)(6)(i)(G) and 8 CFR 214.2(m)(9)(v))).

      Forms I-20 Requirements and Maintaining Student Records for the Fall 2020 Semester

      For all students attending schools in the United States this fall 2020, designated school officials (DSOs) must issue new Forms I-20 to each student certifying that the school is not operating entirely online, that the student is not taking an entirely online course load for the fall 2020 semester, and that the student is taking the minimum number of online classes required to make normal progress in their degree program. DSOs must indicate this information in the Form I-20 Remarks field in the Student and Exchange Visitor Information System (SEVIS).

      Schools must update and reissue all Forms I-20 to reflect these changes in program enrollment and student information within 21 business days of publication of this Broadcast Message (by Aug. 4, 2020.) When issuing new Forms I-20, please prioritize students who require new visas and are outside of the country.

      For the fall 2020 semester, continuing F and M students who are already in the United States may remain in Active status in SEVIS if they make normal progress in a program of study, or are engaged in approved practical training, either as part of a program of study or following completion of a program of study. If a school changes its operational stance mid-semester, and as a result a nonimmigrant student switches to only online classes, or a nonimmigrant student changes their course selections, and as a result, ends up taking an entirely online course load, schools are reminded that nonimmigrant students within the United States are not permitted to take a full course of study through online classes. If nonimmigrant students find themselves in this situation, they must leave the country or take alternative steps to maintain their nonimmigrant status such as transfer to a school with in-person instruction.

      For the fall 2020 semester, continuing F and M students outside of the United States, whose schools of enrollment are only offering online classes, may remain in Active status in SEVIS if they are taking online courses and are able to meet the normal full course of study requirements or the requirements for a reduced course of study. Only students enrolled at a school that is only offering online coursework can engage in remote learning from their home country. In this case, DSOs should annotate the student’s record to make it clear that the student is outside the US but taking full time online courses as that is the only choice offered by the school.

      SEVP will continue to develop and provide resources to stakeholders on ICE.gov, including answers to frequently asked questions, to clarify and expand upon information in this Broadcast Message.

      • Is Texas State resuming face-to-face classes for fall 2020?
        • Yes, we are planning for a return to campus with a Hybrid Plan of both in-person and remote classes, and services in fall 2020. Learn more about the Return to Campus Strategy.
      • What does the Broadcast Message say about a Hybrid Plan?
        • F-1 students will be allowed to take more than one class or three credit hours online.
      • What does this mean for F-1 international students at Texas State?
        • F-1 students are required to maintain a full course of study in fall 2020 (12-hours for undergraduate and 9 hours for graduate students). Review the  F-1 Regulations Overview for more details. In summary with a Fall 2020 Hybrid Plan:
          • F-1 students may take more than one online course to count towards the full-time course requirement as long as students are enrolled in at least 1 face-to-face or hybrid course.

      • What do I do if all of my available fall 2020 classes are only offered fully online?

        • Students unable to maintain a full-course of study will have their SEVIS records terminated for failure to enroll full-time or failure to maintain a full-course of study.
        • Review eligibility for a Reduced Course Load (RCL) and Concurrent Enrollment. Contact a DSO for more information.
      • What if I am graduating in Fall 2020 and I only have 1 course remaining?
        • Current RCL regulations have not changed. If you are in your final semester and are eligible to graduate, submit a Final Semester Reduced Course Load (RCL). The Final Semester RCL allows you to enroll in only your final remaining courses.
        • The final course cannot be an online only courses.
        • If you are unsure if your final courses is online only or not, consult with your professor or academic department.
      • What if my final course is an internship (or equivalent), does this count as an online course?
        • No, if your final course is an internship, or equivalent, you must apply for CPT. Internship courses are considered hybrid.
      • What if I qualify for a medical - academic modification to take my classes remotely?
      • Will ISSS issue me a new I-20 for fall 2020?
        • Yes, per the Broadcast Message, DSOs must issue new Forms I-20 to each student certifying the following: 1) school is not operating entirely online, 2) the student is not taking an entirely online course load for fall 2020 semester, and 3) the student is taking the minimum number of online classes required to make normal progress in their degree program.
        • ISSS will issue all continuing students new I-20s in accordance with SEVP's published deadline. Students are asked to please not contact ISSS requesting a new I-20. Students will be contacted at a later time when new I-20s are ready. *Students do not need a new I-20 to exit the US. If traveling abroad, ISSS will mail new I-20s to students abroad.
      • What if Texas State starts fully online for fall 2020?
        • Per the July 6th SEVP Guidance, F-1 students must depart the US country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status. See more about SEVIS Transfer Out.
        • Students who do not exit the US can potentially face immigration consequences including, but not limited to, the initiation of removal proceedings.
          • At this time, the broadcast message does not address this topic. Referring to previous SEVP - COVID-19 guidance, a DSO will add notes in the student's SEVIS record notating the inability to depart. Per the current broadcast message, students are still expected to depart.
      • What if Texas State starts with a hybrid plan then moves fully online mid-semester?
        • If a school changes its operational stance mid-semester to entirely online course load, F-1 students in the US are not permitted to take a full course of study through online classes. F-1 students must leave the country or take alternative steps to maintain their nonimmigrant status such as transfer to a school with in-person instruction.
          • At this time, SEVP has not issued a statement on how long students could remain in the US after the institution switches to online only courses.
      • If Texas States moves to fully online for Fall 2020, how will this impact my F-1 status and F-1 visa?
        • Per the SEVP Guidance, continuing F students outside of the US attending schools offering only online classes, may remain in Active SEVIS status if they are taking online courses and are able to meet the normal full course of study requirements or the requirements for a reduced course of study. This means, if you enroll full-time abroad, or have an approved RCL, your SEVIS record will remain active.
        • Continuing students' F-1 visa should not be impacted. The Department of State's policy states, “a student does not need to apply for a new F-1 visa if the student’s current visa is still valid, regardless of length of time outside the United States." If you have a valid visa you will be permitted to use the visa to reenter the US at a later time.
          • Should your SEVIS record become terminated, you must request a new I-20 from ISSS and pay the I-901 SEVIS Fee before using a valid F-1 visa to reenter the US. If the visa is expired by the time you plan to renter the US, you must use the new I-20 to apply for a new F-1 visa.
    • Yes, on July 14, 2020 the July 6 SEVP Policy Guidance affecting international students in Fall 2020 was rescinded. Further guidance from SEVP regarding international students and enrollment in Fall 2020 will be published later.

      For now, international students should continue to pursue a full course of study or seek a reduced course load if not enrolling full-time.

      We join with you in celebrating the rollback of the July 6, 2020, announcement from the Department of Homeland Security’s Student Visitor and Exchange Visitor System detailing guidance for fall 2020 enrollment for F-1 international students. While the requirements in the July 6 guidance no longer apply, it is important to expect further updates from SEVP. Texas State F-1 international students should monitor the ISSS COVID-19 Response page for updates and proceed with fall 2020 enrollment plans in expectation of the conditions outlined in the Roadmap to Return.

          • Online classes: instruction is delivered online.
          • Hybrid classes: instruction is delivered primarily online, with some face-to-face instruction.

          • Traditional face-to-face classes: instruction is delivered in-person.

        • Continuing students outside the US who are unable to enroll full-time can submit an Academic Reduced Course Load (RCL) or Contact a DSO for more information.
      • Can a continuing student outside the US enroll fully online and return to the US mid-semester?
        • Yes, students outside the US engaged in 100 percent online coursework will be able to maintain their status and are not subject to loss of F-1 status.
        • Continuing students may enroll fully online while maintaining an active SEVIS record.
        • Students are reminded to ensure they are in possession of a valid F-1 visa before reentering the US. Students planning to return to the US mid-semester should contact ISSS.
      New and Transfer Students in "Initial" Status
      • Can F-1 students outside the US obtain a visa to study if the program is fully online?
        • DSOs are instructed to not issue a Form I-20 for a student in new or initial status who is outside the US and plans to take classes that are fully online.
          • The five-month rule related to SEVIS transfer students will not apply to students affected by COVID-19. DSOs will work with transfer students to adjust their SEVIS record for a future semester start date if needed.
        • As a result, new and initial students who intend to pursue a full course of study that will be conducted completely online will likely not be able to obtain an F-1 visa to study in the US.
      • Can F-1 students outside the US obtain a visa to study if the program is hybrid?
        • Yes, new and initial students are strongly advised to pursue a full-time course of study that includes both face-to-face and online courses.
      • Can new or transfer students who cannot or will not come to campus in Fall 2020 enroll remotely?
        • New students - Yes, work with your academic department to ensure online courses are available. New SEVIS records can be adjusted by the DSO to start for a future semester preserving the I-901 fee, if already paid.
          • Graduate students unable to enroll online may need to contact their academic department and the Graduate College for a program deferral, if possible.
          • Undergraduate students unable to enroll online will need to reapply for a future semester.
          • Transfer students - Yes, work with your academic department to ensure online courses are available.
            • The five-month rule related to SEVIS transfer students will not apply to students affected by COVID-19. DSOs will work with a transfer student to adjust their SEVIS record for a future semester start date.
      If Texas State Moves Fully Online for Fall 2020

International Travel

  • Per the Presidential Proclamation:

    This new proclamation revokes the earlier proclamation which

    "suspended and restricted the entry into the United States of noncitizens of the United States (“noncitizens”) who were physically present within the Republic of Botswana, the Kingdom of Eswatini, the Kingdom of Lesotho, the Republic of Malawi, the Republic of Mozambique, the Republic of Namibia, the Republic of South Africa, and the Republic of Zimbabwe during the 14-day period preceding their entry or attempted entry into the United States."

  • Beginning December 6, 2021, all air travelers, regardless of citizenship or vaccination status, will be to be required to show a negative pre-departure COVID-19 viral test taken the day before they board their flight to the United States. For example, a passenger whose flight to the United States is at any time on a Sunday would need to have a negative test taken at any time on Saturday.

    CDC continues to recommend that all travelers get a COVID-19 viral test 3-5 days after arrival, and that unvaccinated travelers should quarantine for 7 days after travel.

  • Per the November 26, 2021 Presidential Proclamation:

    • the Kingdom of Eswatini,
    • the Kingdom of Lesotho,
    • the Republic of Malawi,

  • Students will need to complete our International Student and Scholar Services (ISSS) Request Form and email the completed form to international@txstate.edu 

    1. ISSS will print a new I-20, provide a travel signature, and inform the student the request is complete. 
    2. The student can pick up the new I-20 from the Thornton House or request a shipping label for the I-20 to be mailed.
    3. Please request a shipping label through this link: https://study.eshipglobal.com/  Select the "International Office" as the shipping department. 

    Note: You may leave the country without a travel signature.

  • The Centers for Disease Control and Prevention (CDC) provides additional information regarding the November 8 full vaccination requirement.

    • You must be fully vaccinated to travel to the United States by plane if you are a non-U.S. citizen, non-U.S. immigrant (not a U.S. citizen, U.S. national, lawful permanent resident, or traveling to the United States on an immigrant visa). Only limited exceptions apply.
    • You are required to show a negative COVID-19 test result or documentation of recovery from COVID-19 when you travel to the United States by air. The timing of this test depends on your vaccination status and age.
    • Wearing a mask over your nose and mouth is required in indoor areas of public transportation (including airplanes) traveling into, within, or out of the United States and indoors in U.S. transportation hubs (including airports).
  • The Centers for Disease Control and Prevention (CDC) has announced a new Order for all air passengers traveling to the United States. Effective November 8, 2021, all non-immigrant, non-citizen air travelers to the United States will be required to be fully vaccinated and to provide proof of vaccination status prior to boarding an airplane to the United States.

    Exceptions to this policy will be extremely limited:

    • children under 18
    • people medically unable to receive the vaccine
    • emergency travelers who do not have timely access to a vaccine

    Humanitarian exemptions to this order will be granted on an extremely limited basis.

    U.S. citizens and Legal Permanent Residents (LPRs) who are eligible to travel but are not fully vaccinated will need to provide proof of a negative COVID-19 test one (1) day before their flight’s departure. U.S citizens and LPRs who are fully vaccinated will need to present airlines with proof of vaccination and of a negative COVID-19 test three (3) days before their flight.

    The CDC recommends that you do not travel internationally until you are fully vaccinated. International travel poses additional risks, and even fully vaccinated travelers might be at increased risk for getting and possibly spreading some COVID-19 variants. Delay travel and stay home to protect yourself and others from COVID-19. If you do travel, follow all CDC recommendations before, during, and after travel.

    With specific exceptions, several Presidential proclamations suspend and limit entry into the United States, as immigrants or nonimmigrants, of noncitizens who were physically present within the following countries during the 14-day period preceding their entry or attempted entry into the United States. For a full list of exceptions, please refer to the relevant proclamations in the links below.

  • On March 20, 2020 U.S. Customs and Border Protection (CBP) published a regulation restricting non-essential cross-border traffic from Mexico and Canada. This restriction has been extended to May 21, 2021. Further extensions are possible depending on the state of the COVID-19 pandemic.

    Admission to the US is permitted only for travelers engaged in “essential travel.” CBP defined “essential travel” to include international students by stating, "Individuals traveling to attend educational institution" and "Individuals traveling to work in the US" for students on OPT or STEM-OPT.

    Many CBP officers are inquiring as to the essential nature of the student's study or work in the US. Students are therefore cautioned to be prepared to explain the essential nature of their study and return to campus and/or work. Students are advised to be prepared to be refused entry if they are not able to demonstrate such to the satisfaction of CBP, even if they are in possession of valid entry documentation and work authorization in the US, and they are returning to the US to study or work.


    If you are at the border and need to reach a DSO, call Texas State University International Student and Scholar Services at 512-245-7966 or the University Police Department after hours (5pm CST M-F and weekends) at 512-245-2805. A DSO can sometimes advocate to CBP to grant you admission to the US.

  • On April 30, 2021, President Biden signed a Proclamation suspending the entry of certain nonimmigrant travelers who have been physically present in India, which will go into effect at 12:01 AM EDT on Tuesday, May 4.

    Immigrants, U.S. citizens, and lawful permanent residents (LPR) are not subject to the proclamation. Consistent with exceptions under prior geographic-related proclamations addressing the Novel Coronavirus, the suspension of entry also does not apply to non-U.S. citizen spouses or unmarried children under the age of 21. When the U.S. citizen or LPR is a child, the foreign national parents and siblings of the U.S. citizen child or LPR may accompany the child (provided the U.S. citizen or LPR, and any siblings, are under the age of 21 and unmarried). Other exceptions include, but are not limited to: foreign diplomats traveling to the United States on A or G visas, and air and sea crew traveling to the United States on C, D, or C1/D visas. For the full list of those not subject to the Proclamation, please refer to the Proclamation text, available on the White House website.

    The Secretary of State has determined that the travel of the following individuals is in the national interest for purposes of approving exceptions under the geographic COVID Presidential Proclamations, including those subject to restrictions under this Proclamation:

    • Immigrants (not applicable to the restrictions under the April 30, India Proclamation, which only covers nonimmigrant travel)
    • Fiancé(e)s
    • Students and certain academics covered by exchange visitor programs.
      • Students subject to these geographic COVID proclamations due to their presence in India, China, Iran, Brazil, or South Africa, may qualify for a National Interest Exception only if their academic program begins August 1, 2021 or later.
      • [CONTINUING] Students with valid F-1 and M-1 visas intending to begin or continue an academic program commencing August 1, 2021 or later do not need to contact an embassy or consulate to seek an individual National Interest Exception to travel. They may enter the United States no earlier than 30 days before the start of their academic studies.
      • [NEW] Students seeking to apply for new F-1 or M-1 visas should check the status of visa services at the nearest embassy or consulate; those applicants who are found to be otherwise qualified for an F-1 or M-1 visa will automatically be considered for a national interest exception to travel.
    • Travelers who are seeking to provide vital support for critical infrastructure sectors
    • Journalists
    • Pilots and aircrew traveling to the United States for training or aircraft pickup, delivery, or maintenance, including individuals who are traveling to the United States on B-1/B-2, B-1, or M-1 visas, or Visa Waiver Program authorizations. This also include certain M-2 dependents when the principal’s necessary training is four weeks or more.
    • Certain exchange visitors, including:
      • Travel by an au pair to provide care for a minor U.S. citizen, LPR, or nonimmigrant in lawful status when the au pair possesses special skills required for a child with particular needs (e.g., medical, special education, or sign language).
      • Travel by an au pair that prevents a U.S. citizen, lawful permanent resident, or other nonimmigrant in lawful status from becoming a public health charge or ward of the state or of a medical or other public funded institution.
      • Travel by an au pair to provide childcare services for a child whose parents are involved with the provision of medical care to individuals who have contracted COVID-19 or medical research at United States facilities to help the United States combat COVID-19.
      • Travel for an exchange program conducted pursuant to an MOU, Statement of Intent, or other valid agreement or arrangement between a foreign government and any federal, state, or local government entity in the United States that is designed to promote U.S. national interests if the agreement or arrangement with the foreign government was in effect prior to June 24, 2020.
      • Travel by Interns and Trainees on U.S. government agency-sponsored programs (those with a program number beginning with "G-3" on Form DS-2019): An exchange visitor participating in an exchange visitor program in which he or she will be hosted by a U.S. government agency and the program supports the immediate and continued economic recovery of the United States.
      • Travel by Specialized Teachers in Accredited Educational Institutions with a program number beginning with "G-5" on Form DS-2019: An exchange visitor participating in an exchange program in which he or she will teach full-time, including a substantial portion that is in person, in a publicly or privately operated primary or secondary accredited educational institution where the applicant demonstrates ability to make a specialized contribution to the education of students in the United States. A “specialized teacher” applicant must demonstrate native or near-native foreign language proficiency and the ability to teach his/her assigned subject(s) in that language.
      • Travel in support of critical foreign policy objectives: This only includes exchange visitors participating in a small number of exchange programs that fulfill critical and time sensitive foreign policy objectives.
    • Derivative family members accompanying a noncitizen who is excepted from or otherwise not subject to the Proclamation and who is engaging in certain types of long-term employment, studies, or research of four weeks or longer.

    The Department of State also continues to grant National Interest Exceptions for qualified travelers seeking to enter the United States for purposes related to humanitarian travel, public health response, and national security. These travelers and any others who believe their travel to be in the United States’ national interest should also review the website of the nearest U.S. embassy or consulate for instruction on how to contact them.

    Travelers in these categories who wish to visit the United States and have a valid visa in the appropriate class, or who are seeking to apply for a visa, and believe they may qualify for a national interest exception should contact the nearest U.S. embassy or consulate before traveling.

    If circumstances warrant, the Secretary of State may revise the national interest determinations at any time.

  • Travel – Restrictions to the U.S. from Specific Regions

    • Presidential Proclamations are still in effect and restrict travel to the U.S. for individuals who were physically present in a country/region within the 14 days preceding travel to the U.S. These areas include:
      • Brazil, China, Iran
      • Schengen Area (Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland)
      • United Kingdom (England, Scotland, Wales, Ireland)
      • South Africa
    • Students may quarantine in a third country before traveling to the US to satisfy the 14-day restriction. Consult with ISSS to confirm your travel if you are from one of the above-mentioned countries/regions.
  • Requirement for Proof of Negative COVID-19 Test Result for All Airline Passengers Arriving into the United States (US) from the United Kingdom (UK)

    The Centers for Disease Control and Prevention (CDC) within the Department of Health and Human Services (HHS) issued an Order on December 25, 2020 requiring proof of a negative COVID-19 test for all air passengers arriving from the UK to the US. This Order will go into effect at 7:01pm EST on December 27, 2020 (12:01 AM GMT on December 28, 2020).

  • On July 24, 2020 - CBP published a travel document that includes waivers of Presidential Proclamations 9993 (Schengen Area) and 9996 (United Kingdom and Ireland) for Academics and Students. The document specifies:

    Students with valid F-1 visas, and their F-2 and M-2 dependents traveling from or otherwise physically present in the Schengen Area, the United Kingdom, or Ireland during the preceding 14 days may travel to the United States while these Proclamations are in effect. F and M visa holders subject to these Proclamations have been granted a national interest exception to travel and can be boarded without contacting CBP as long as all admissibility and document requirements are met.

    Bring the following documents when traveling to the US:

    • Valid passport
    • Valid F-1 Visa
    • I-20 with travel signature
    • CBP Travel Document referencing the above statement

    Students are encouraged to only fly into the US at one of the 15 designated airports listed in the document.

Personal Well-being

  • Be aware that criminals are attempting to exploit COVID-19 worldwide through a variety of scams. The Department of Justice reports the following:

    • Individuals and businesses selling fake cures for COVID-19 online and engaging in other forms of fraud.
    • Phishing emails from entities posing as the World Health Organization or the Centers for Disease Control and Prevention.
    • Malicious websites and apps that appear to share virus-related information to gain and lock access to your devices until payment is received.
    • Seeking donations fraudulently for illegitimate or non-existent charitable organizations.

    The Federal Communications Commission (FCC) offers the following tips to help you protect yourself from coronavirus scams:

    • Do not respond to calls or texts from unknown numbers, or any others that appear suspicious.
    • Never share your personal or financial information via email, text messages, or over the phone.
    • Be cautious if you’re being pressured to share any information or make a payment immediately.
    • Scammers often spoof phone numbers to trick you into answering or responding.  Remember that government agencies will never call you to ask for personal information or money.
    • Do not click any links in a text message. If a friend sends you a text with a suspicious link that seems out of character, call them to make sure they weren't hacked.
    • Always check on a charity (for example, by calling or looking at its actual website) before donating. (Learn more about charity scams.)

  • The Student Health Center (SHC) is open and asks that students always call first. You will be instructed on what type of health service you will need, e.g. self-care at home, telehealth visit, SHC appointment, etc.

    Testing for COVID-19 is available at the main Student Health Center for persons who meet our testing criteria. If you would like to be evaluated for testing, for COVID-19 at the Student Health Center, call the Student Health Center at 512.245.2161.

    A. Based on IRS Substantial Presence Rule – Most international students and scholars in the US are nonresidents in the US for tax purposes

    A. Significant number of international students and scholars make the mistake as filing as a resident for tax purposes

    B. Most tax services (Turbotax, H&R Block, Tax Act, local CPA’s etc – are designed to help residents – not nonresidents – not international students and scholars)

    C. Filing incorrectly means you are claiming benefits and deductions you are not entitled to

    D. TurboTax specifically say they cannot help nonresidents

    DO NOT USE A RESIDENT TAX RETURN PREPARATION SERVICE UNLESS YOU ARE CERTAIN THAT YOU ARE A RESIDENT FOR TAX PURPOSES

    4. Recommended next steps:

    A. If you have received the Economic Impact Payment (stimulus check)

    i. Check what tax return you prepared in 2018 or 2019

    ii. Was it a 1040 (for residents) or a 1040NR (for nonresidents)?

    B. If it was a 1040 you filed as a resident for that year.

    i. Log in to Sprintax

    ii. Sprintax will guide you through the substantial presence test and confirm if you were a resident or nonresident for that tax year

    Complete the Substantial Presence Test for free with Sprintax

    C. If you filed as a resident and Sprintax confirms you are a resident – no further action required at this moment

    D. HOWEVER – If Sprintax finds that you are a nonresident then you should have filed as a nonresident – you need to prepare and send an amended tax return (1040X) to the IRS to correct this

    E. Sprintax will help you prepare your amended return, for any year

    i. We recommend you do this as quickly as possible

    ii. Once you have your Sprintax amended return, mail this to the IRS.

    iii. Separate to your amended return – return the stimulus payment. The IRS provide instructions here: https://www.irs.gov/taxtopics/tc161

    5. Future possible implications:

    A. Filing an incorrect tax return may cause fees and penalties to accrue with the IRS.

    B. Incorrect tax filing will also impact a change of visa status or a future visa application – so please ensure now that you have prepared your taxes correctly for 2020 and previous years.

OPT & STEM OPT

  • ISSS will no longer conduct 1-on-1 in person appointments for OPT.

    Students are expected to submit all required documents online for a DSO to review. The DSO will create the recommendation in SEVIS and mail the new OPT requested I-20 to the student.

    Students are expected to mail all required documents directly to USCIS. ISSS will no longer mail OPT applications to USCIS on behalf of students.

  • What happens to my OPT/STEM OPT unemployment limit if I am laid off or placed on temporary leave and can no longer work due to COVID-19?

    There is a distinct difference between being laid off or placed on temporary leave when your employer is suspending service or closed.

    • Being laid off - you are no longer employed with your employer with no option to return to work.
      • You must update the SEVP Portal to report your employment end date. This update must be done within 10 days from being laid off. You will begin to accrue unemployment days from the day you are laid off.
    • Temporary leave - your workplace is temporarily closed, but you will keep your position once your employer reopens.
      • Although you are not working, you are not required to update the SEVP Portal with an employment end date. Days not working do not count as unemployment days.

    Both SEVP and USCIS have yet to offer guidance on the unemployment day limit during COVID-19. Continue to monitor the Department of Homeland Security's Study in the States website for updates from these federal agencies.


    In the absence of new information, we must operate with existing regulations. Please understand the current regulations regarding unemployment day limits and maintaining your F-1 status while on OPT/STEM OPT.

    DHS defines the Periods of Unemployment During OPT by stating:

    During post-completion OPT, F-1 status is dependent upon employment. Students may not accrue an aggregate of more than 90 days of unemployment during any post-completion OPT period described in 8 CFR 274a.12(c)(3)(i)(B). Students granted a 24-month OPT extension under paragraph (f)(10)(ii)(C)(2) of this section may not accrue an aggregate of more than 150 days of unemployment during a total OPT period, including any post-completion OPT period described in 8 CFR 274a.12(c)(3)(i)(B) and any subsequent 24-month extension period.

    Students are reminded of the following options to maintain status if approaching the maximum number of unemployment days allowed:

    1. Depart the US and complete the SEVIS Record Completion Request. *Be mindful of any current travel restrictions. Consult with an immigration attorney if you are stranded in the US due to travel restrictions. Or consult with your embassy in the US regarding emergency evacuation.
    2. Be admitted to a new program at Texas State and apply for a Change of Level I-20
    3. Apply for a Change of Status to a different visa classification
    4. Apply for SEVIS Transfer to a new institution

    Alternative Employment

    Both of the following will stop the unemployment clock for students on OPT. These options are not available to students on STEM OPT.

    1. Self-Employment
    2. Volunteering

    Students are required to still adhere to the conditions of OPT such as 1) engaging in work that is directly related to your major, and 2) work at least 20 hours per week. Both are acceptable and must be reported in the SEVP Portal in order to stop the unemployment clock.

  • Many students have expressed concern regarding USCIS office closures. Please review the USCIS website for updates.

    On March 18, U.S. Citizenship and Immigration Services temporarily suspended routine in-person services to help slow the spread of coronavirus (COVID-19). USCIS plans to begin reopening our offices on May 4, unless the public closures are extended further. USCIS staff are continuing to perform duties that do not involve contact with the public.

    OPT and STEM OPT applications are still being processed. If this changes, you will see updates on the USCIS website.

    To see current Form I-765 work authorization for OPT/STEM processing time, refer to the USCIS Check Processing Time.

  • If you are planning to complete your program in Spring or Summer 2020 and apply for OPT, be advised that USCIS has not changed the regulation requiring students to apply for OPT while inside the US. The Form I-765, page 4: part 3 states,"You must file Form I-765 while in the United States."

    Please review the following:

    1. If you already applied for OPT, you can depart the US while your OPT application is pending. USCIS will mail your OPT documents to the mailing address you entered on the Form I-765. If you used the ISSS address, ISSS will continue to update you as mail is received.
    2. If you are planning to apply for OPT, please apply before departing the US. 
    3. If this is your final semester and you have already departed the US without applying for OPT, at this time, you have two options:
      1. Return to the US before your program end date (May 16 for Spring graduates and August 8 for Summer graduates) and apply for OPT. Given the current travel restrictions, this might not be possible.
      2. Apply for OPT while outside the US. If your OPT is denied by USCIS this means you will be forfeiting your OPT and there is no appeal.
  • If you are participating in practical training, work with your employer to maintain practical training agreements. If changes have been made to your workplace environment, you should consult with your employer to seek alternative ways to maintain training agreements, such as teleworking, remote working, or other arrangements.

    At this time SEVIS has not announced any changes to current OPT/STEM OPT regulations; no extensions in unemployment days or authorized employment periods.

USCIS

  • You may have seen posts on social media suggesting special opportunities for off-campus work authorizations for F-1 students due to COVID-19.

    The USCIS page in question was created on October 25, 2019. Please know none of the mentioned situations are new and specific to COVID-19. F-1 student eligibility for some of these programs are extremely limited.

  • On April 13, 2020, USCIS published a website that discusses nonimmigrants being eligible to apply for an Extension of Stay (EOS).

    Unfortunately, this information is misleading as F-1 students are not eligible for an extension of stay. As an F-1 student your I-94 admit until date shows D/S, duration of status. This means you may remain in the US as long as you have a valid I-20. The EOS application is to extend an international person with a date-specific I-94. 

    F-1 students nearing their I-20 end date and have not applied for OPT have the following options to extend their F-1 status:
    1. Apply for a I-20 Program Extension
    2. Apply for OPT
    F-1 students on OPT or STEM OPT have the following options to extend their legal stay in the US:
    1. Apply for STEM OPT (for OPT students)
    2. Be admitted to a new program of study at Texas State and apply for a Change of Level I-20.
    3. Be admitted to a new program of study outside Texas State and apply for a SEVIS Transfer.
    4. Timely file for a change or adjustment of status. If approved, update your immigration status using the Immigration Status Update Portal.

    Currently, DHS has not issued any changes to regulations governing OPT and STEM OPT. There are no changes to work authorization periods or leniency for exceeding unemployment day limits. There is no option for a student on OPT or STEM OPT to extend work authorization beyond the EAD end date.

    An F-1 student who does not utilize one of the options mentioned above must depart the US no later than 60-days from the I-20 or OPT/STEM-OPT end date. If you are unable to depart the US due to travel restrictions or other extenuating circumstances, please schedule an appointment with a DSO.

    On March 18, U.S. Citizenship and Immigration Services temporarily suspended routine in-person services to help slow the spread of coronavirus (COVID-19). USCIS plans to begin reopening our offices on May 4, unless the public closures are extended further. USCIS staff are continuing to perform duties that do not involve contact with the public.

    OPT and STEM OPT applications are still being processed. If this changes, you will see updates on the USCIS website.

    General Information

    On April 21, 2021, the U.S. Department of Homeland Security (DHS) posted Federal Register notices announcing the suspension of certain regulatory requirements for F-1 nonimmigrant students from Venezuela and Syria who are experiencing severe economic hardship as a result of emergent circumstances in their country of citizenship.

    These notices temporarily suspend applicable on-campus and off-campus employment regulations for eligible Venezuelan and Syrian students. DHS will continue to monitor the situations in Syria and Venezuela and will announce any additional modifications or extensions to these notices in the Federal Register.

    The notice applies exclusively to F-1 nonimmigrant students who meet who meet all of the following conditions:

    • Are citizens of Venezuela or Syria,
    • Were lawfully present in the United States in an F-1 nonimmigrant status on April 22, 2021,
    • Are enrolled in an SEVP-certified school,
    • Are currently maintaining F-1 nonimmigrant status, and
    • Are experiencing severe economic hardship as a direct result of the humanitarian crisis in Venezuela or ongoing civil unrest in Syria since March 2011.

    The suspension of these requirements will remain in effect until:

    • Sept. 9, 2022 for Venezuelan students.
    • Sept. 30, 2022 for Syrian students.

  • Due to the COVID-19 pandemic and other factors, USCIS is experiencing delays in issuing receipt notices for some applications and petitions filed at a USCIS lockbox facility. The information below explains the current state of our lockbox operations and the issues affecting receipt notices.

    Current Situation

    As a result of COVID-19 restrictions, an increase in filings, current postal service volume and other external factors, you may experience a delay of four to six weeks in receiving your receipt notice after properly filing an application or petition with a USCIS lockbox. These delays will not affect the receipt date which is determined pursuant to 8 C.F.R. 103.2(a)(7). Delays may vary among form types and lockbox locations. In some cases, you may experience significant delays if you filed a non-family based Form I-485, Application to Register Permanent Residence or Adjust Status, or Form I-765, Application for Employment Authorization, based on eligibility categories described in 8 C.F.R. 274a.12(c)(3), relating to F-1 students.

    The health and safety of our workforce remains a top priority. Across all USCIS offices, including lockbox facilities, the agency has taken necessary measures such as increased social distancing and frequent cleaning in accordance with the Centers for Disease Control guidance to mitigate the spread of COVID-19. Some lockbox operations in locations that have been severely impacted by COVID-19 must adhere to stricter local guidelines.

    What USCIS Is Doing

    The USCIS lockbox workforce¹ is working extra hours and redistributing its workload in order to minimize delays. Once we open and process your application, we print and mail the receipt notice. We do not anticipate any receipting delays that would result in a payment that is past its validity date. What You Can Do If you have already filed your application and are waiting for your receipt notice, we appreciate your patience. We are working as quickly as possible to complete the intake of all filings.

    You can take steps to decrease the time it takes us to process and send your receipt notice or find out the status of your case:

    • Create a free USCIS online account and check the status of your case from your mobile device, anywhere, anytime using our case status online tool; or

    • Complete Form G-1145, E-Notification of Application/Petition Acceptance, and clip it to the front of your form when filing at a USCIS lockbox to request a text message and/or email when we accept your form.
